Why choose Michael Simms as our next Circuit Court Judge?

Michael is a West Virginia native, married, with two children. He has owned and operated a solo law practice in Morgantown for over seventeen years, representing Veterans, children, victims of abuse and neglect, juveniles, students, people who have been injured, and members of traditionally underserved communities. He has regularly provided pro-bono (free) service throughout his career, and currently serves as the pro-bono attorney for Aspire Services, Inc., a Veteran-preferenced nonprofit.

In 2021, Michael was appointed by Governor Justice as Chairperson the County's first Public Defender Corporation (PDC). Michael serves in this capacity without compensation, and the PDC now provides high-quality, ethical, holistic legal representation, with the goal of reducing the rates of reoffending, and providing individuals with the resources they need to lead productive lives, free from the criminal justice system.

Experience that Matters

With nearly twenty years of legal experience, Michael has witnessed the challenges individuals face in our justice system. He has fought tirelessly to protect his clients’ rights, all while helping them transition to leading healthier, more productive lives. Michael has practiced in all major areas that come before the Court, including serious criminal matters, child abuse and neglect, civil litigation, juvenile representation, and administrative law.

Public Service

Michael is dedicated to public service, both professionally and personally. In 2021, he was appointed by Governor Justice to establish the County's first Public Defender Corporation (PDC), which is now fully-operational. Michael is also involved in various community service organizations, such as Cheat Lake Rotary, and ASPIRE Services, Inc.

Integrity

Michael's personal integrity and meticulous approach to the law have earned him respect and trust from clients and colleagues. He is known for treating everyone with dignity and respect, regardless of their background or life experience. He always puts his clients' best interests first, and is known as a dedicated advocate. In all of his years of practice, he has never had a complaint with the Office of Disciplinary Counsel.

Michael will bring experience, integrity, a focus on community safety, fairness, and commitment to public service to the bench.
